DUI charges against Constable dropped by DA

LAS VEGAS -- Las Vegas Township Constable John Bonaventura will not face criminal charges related to his Feb. 12 arrest on suspicion of driving under the influence of alcohol and speeding.

The breath test given to Bonaventura that would have been admissible in court showed that Bonaventura had a blood alcohol level of 0.069. The legal limit in Nevada is 0.08.

According to the arrest report, Bonaventura’s preliminary breath test indicated he was over the legal limit. However, state law does not allow this preliminary breath test to be used as evidence in court.

Clark County District Attorney Steven B. Wolfson in a statement said further investigation also showed that a different constable’s office vehicle may have been speeding, instead of the vehicle Bonaventura was driving at the time of his arrest.

"For these reasons I do not believe that this office could prove Mr. Bonaventura’s guilt beyond a reasonable doubt," Wolfson said.
