LAS VEGAS -- The Henderson police sergeant caught on video kicking a man who was experiencing diabetic shock is now the subject of a federal grand jury investigation.
News 3 has confirmed through our sources that a federal grand jury has been hearing evidence about the incident.
The dashboard video, which was first released about a year ago shows an October 29, 2010 incident in which a driver is pulled over by highway patrol troopers. Moments later a Henderson officer is seen kicking him in the head.

The Henderson police officer seen kicking is Sergeant Brett Seekatz. The video shows him kicking the man on the ground five times.
The police officers realized later that Adam Greene was apparently having a diabetic episode. Officers even found insulin in his pocket.
Sergeant Seekats was disciplined by the department but he did not lose his job, nor was he demoted.
Clark County district attorney Steve Wolfson also looked at the case but declined to take action.
Wolfson said kicking is sometimes allowed within Henderson police policy and he chose to not press charges.
Greene settled with the city of Henderson and the state for $300,000 nd until now, no further action has been taken.
