LAS VEGAS (KSNV MyNews3) -- The two brothers accused of beating up a special education teen captured in the video will stay behind bars after pleading guilty in family court.
The decision came down this morning after the boys pleaded guilty to battery charges before Judge William Voy in family court.
The boys had very different reactions. The 15-year-old was stoic and did not show much emotion at all. But it was his 13-year-old younger brother who cried and asked the judge to consider letting him go home.
The parents claim their teens have a history of anger problems and post traumatic stress disorder after the witnessed their mom and dad get shot during a home invasion robbery.
The parents also say the younger boy was the victim of constant bullying as recently as this year, while the older one has behavioral problems so bad he's medicated for them and is home schooled.
Video of the incident captured by another male was uploaded to livelink.com. The video went viral with more than 50,000 page views before it was later removed.
The brothers had separate hearings and both admit it is them in the online video punching a special education student.
This is the first time the 13-year old has had a run-in with the law. The 15-year-old has a criminal record for graffiti. He pled guilty to violating his probation.
Today his probation officer told the judge the older boy failed to stay out of trouble, like he was supposed to.
That played a huge role in the judge's decision to keep him in custody.
