LAS VEGAS (KSNV MyNews3.com) -- The man suspected in a fatal carjacking that began on the Strip and ended near the Rio Hotel and Casino had his court appearance rescheduled.
James Montgomery, 29, is facing multiple charges -- including murder and kidnapping -- after Metro police say he stole a California Highway Patrolman’s truck Aug. 18 at the Flamingo Hotel then wrecked the vehicle with the CHP officer and another man in the truck bed, near the Rio Hotel.
The two victims, 33-year old CHP Officer Jesus Manuel Magdaleno Jr. and 31-year old Felix Brandon Cruz III, were thrown from the truck when Montgomery allegedly ran a red light another vehicle at an intersection near the Rio.
Magdaleno died at the scene. Cruz died from his injuries the next night.
Defense lawyers asked for and received more time to prepare their case. Montgomery will next appear in court at 8 a.m. Nov. 4.
