CHICAGO (AP) — Two Chicago men are suing a taxi company after they say a driver kicked them out of a cab for a short kiss.

The Chicago Sun-Times ( ) reports Matthew McCrea and Steven White filed a lawsuit against Sun Taxi.

The lawsuit says the men were riding in a taxi from the airport when McCrea gave White a one-second long kiss. It says the driver pulled over on the highway and told the men to get out, but they refused.

The cabbie continued driving, called 311 and was transferred to 911. The men say the driver told police that McCrea and White were "making sex" in the cab.

The lawsuit filed Monday says the incident violates the Illinois Human Rights Act and seeks an undisclosed amount in damages.

A person who answered the phone at Sun Taxi Wednesday asked a reporter to call back in an hour.
