SARASOTA, Fla. -- A homeless man spent the night in a Florida jail after charging his cell phone in a Sarasota public park.

Police officers charged 29-year-old Darren Kersey with "theft of utilities".

Kersey, who could not afford the $500 bond, spent Sunday night in jail.

He was released Monday morning when a judge dropped the charges against him, saying the arresting officer didn't have probable cause to make an arrest.
