LAS VEGAS (KSNV MyNews3.com) — The office manager of Dr. Dipak Desai’s endoscopy clinic has agreed to plead guilty to federal charges resulting from the 2007 hepatitis C outbreak.
In a memorandum filed Tuesday with the U. S. District Court, Tonya Rushing, 45, agreed to plead guilty to one count of conspiracy to commit health care fraud, to pay $50,000 in restitution and to forfeit with Desai $8.1 million in cash and property.
Under the agreement, Rushing could face up to 30 months in prison but is eligible for a reduction in jail time for her cooperation with federal prosecutors.
A federal grand jury indicted Desai and Rushing in April 2011 on one count of conspiracy and 25 counts of health care fraud.
The government accused the two of submitting fraudulent bills to Medicare, Medicaid and private insurance companies that falsely inflated the amount of anesthesia time spent during procedures at Desai’s clinic.
Desai, who is serving time at the Northern Nevada Correctional Center in Carson City on conviction of state charges, is scheduled to stand trial on the federal indictment Aug. 8.
