LAS VEGAS (KSNV MyNews3) -- The case against the driver involved in a deadly bus stop crash more than two months ago is in attorney limbo after a preliminary hearing this morning.

Gary Lee Hosey Jr. Is accused of driving under the influence when the vehicle he was driving slammed into a bus stop on Spring Mountain and Decatur on Sept. 13, killing four people and injuring eight.

At the hearing, it was disclosed that the cost of defending Hosey against the allegations has drained his family's resources to the point that a public defender will have to take the case.

The hearing was continued until Nov. 21, provided that another attorney --without conflict in the current case -- will be found.

Kristina Wildeveld, Hosey's attorney, told News 3 outside the courtroom that the thousands of pages of discovery -- and tests and police reports -- have cost the family thousands of dollars to the point where they can no longer pay for representation.

It also was disclosed that Hosey is unemployed and that he was commuting back and forth from California to stay with his Las Vegas girlfriend.

He says it was her car -- he allegedly drove under the influence when it crashed into a bus stop.
