Henderson sues to try to stop land sale to arena developer

HENDERSON (KSNV MyNews3) -- The city of Henderson files a lawsuit against developers of a proposed arena-complex near The M Resort.

The suit alleges developer Chris Milam and four other defendants misled city leaders in the deal.

It claims they encouraged the city to push through the Bureau of Land Management land sale when, in the end, all they really wanted was to sell the land for residential housing.

Attorney Jacob Hafter represents one of the defendants, local attorney John Marchiano.

"It would really be surprising that so many people, so much time and effort by so many, would have gone into this if this was nothing more than a fraud," Hafter said.

Hafter says his client absolutely believed the stadium would eventually be built after all renderings were created and countless hours had already been invested.

The deal apparently fell through though at the last minute when Milam and his team realized the funding for it wouldn't work and wanted to renegotiate.

"The city didn't take lightly to the fact the issue was raised when it was raised on the 24th hour,” Hafter said, “and has subsequently concocted a grandiose scheme of fraud and use words in the complaint as camaraderie and the like in describing it, and it's nothing more than legal fiction."

The Henderson lawsuit calls for a halt to the land sale. At this point, however, the sale is still set to be complete in early February.

Henderson still has control of the zoning, and currently the land is zoned for an arena-type project only.
