LAS VEGAS (AP) -- A defense lawyer says that the ailing doctor who owned a southern Nevada endoscopy clinic isn't fit to stand trial on felony charges stemming from a 2008 hepatitis outbreak, despite the findings of state psychiatrists.
Clark County District Judge Kathleen Delaney on Tuesday set a Nov. 15 date to review a fitness challenge by Dipak Desai's attorney, Richard Wright.
The 61-year-old Desai was evaluated for several months at a state mental hospital in Sparks. Doctors there deemed him fit for trial.
Wright says Desai is mentally incapacitated after two strokes and can't help his own defense.
Desai is accused of being responsible for seven people becoming infected with hepatitis C at his clinics. He and two nurses face charges including racketeering, fraud and neglect of patients.
A trial is scheduled for March.
