Report: Blood alcohol test for accused driver below legal limit

LAS VEGAS (KSNV MyNews3) -- News 3 has learned that blood-alcohol tests on accused driver Gary Hosey Jr. show he was not legally drunk at the time of the crash.

Hosey faces four counts of DUI resulting in death as a result of the Sept. 13 rollover accident that killed four people at a bus stop on Spring Mountain near Decatur. Eight others were injured.

The police report stated that the test on Hosey with a “portable breath device showed a blood alcohol content over the illegal percentage of .08.”

Investigators and prosecutors are still checking to see if other types of intoxicating chemicals were in Hosey's system.

Hosey is scheduled to return to court at 7:30 a.m. Friday.

White people ben getting double standard since america was concieved! Cut that crap out it dont matter what color he is. Dui offenders all look the same and smell of one or two things drugs and drink. I have heard no one side with what he has done. But what is clear is that you realy wanna say lets get the rope and hang this n@@@a right away. He will pay for what he has done let God be the judge.Its not double standards that infuriates you it black people period.

Just because his blood alcohol level was below the legal limit, he can still be charge with driving a motor vehicle while impaired. But, it makes no difference, Hosey was driving recklessly which resulted in death. His best bet is to plead guilty and accept his penalty just like Nathan Moist but he needs to remember his sentence will be times 4.

I agree, the use of the race card is a bunch of crap. He was speeding, under the influence and should be punished accordingly. Race or color is not the issue here.

irregardless, Hosey is at fault. though being ethic Ne-g-ro, media seems to side with Hosey infiring the "Race Card." double standard for Ne-gr-os infuriates me.!!!
