Former prosecutor says chances for new trial for OJ will be difficult

LAS VEGAS (KSNV & MyNews3) -- OJ Simpson is back at a northern Nevada prison after spending last week in Las Vegas.

He's now waiting to find out if he'll get a new trial on robbery and kidnapping charges that sent him away in 2008.

He claims his lawyer did a bad job. News 3's Denise Rosch takes a look at his chances.

Denise Rosch talked with former district court judge, and former prosecutor David Wall about this procedure.

He says it's common for defendants to blame their attorneys when they're convicted, but winning a new trial on those grounds, isn't easy.

“The standard is a hard one. You have to show first of all that there were errors. That the trial lawyer's performance fell below a standard of reasonableness and then you have to show that but for those errors, the outcome would have been different,” said Wall said. “And that's a tough mountain to climb.”
