December court hearing next for Metro chalk protesters

LAS VEGAS (KSNV MyNews3.com) -- Three of the four people arrested and charged for protesting Metro with sidewalk chalk were in a courtroom this morning at the Regional Justice Center.

Brian Ballentine, Kelly Patterson and Hailee Jewell were charged with two counts each of placing graffiti on or defacing property; and conspiracy to commit a non-felony crime.

It was a status check to establish where each defendant stands in the case and ensure they all have representation. There was one request made regarding the surveillance system at the Regional Justice Center that the defense believes is critical to its case.

Attorney Robert Langford, who represents three of the defendants, requested the judge issue a freeze on the surveillance system at the building so they can try to retrieve video from the day in question.

The four protesters were arrested in July for using washable colored chalk on the sidewalks outside Metro headquarters and the RJC.

If convicted, they could face up to a year in jail.

Metro claims the cost to clean-up the chalk totaled more than $1,500. The defense says that was an intentional exaggeration to increase the severity of the charges and make it more expensive to bail out of jail.

A preliminary hearing has been set for December.
