LAS VEGAS (KSNV MyNews3.com) -- The attorney of the man accused of killing a California Highway Patrol officer and his brother-in-law asked for more time to prepare for a preliminary hearing.
James Montgomery, 29, of Tustin, Calif., is facing numerous charges -- including murder and kidnapping – in connection to the deaths of Officer Jesus Magdaleno and Felix Brandon Cruz III, who were in Las Vegas for Magdaleno’s bachelor party.
Montgomery again wore a bandage on his head during his appearance at the Regional Justice Center.
Metro police say Montgomery stole Magdaleno’s truck Aug. 18 at the Flamingo Hotel, then wrecked the vehicle with the Magdaleno and Cruz in the truck bed, near the Rio Hotel. Both men were thrown from the truck. Magdaleno died at the scene. Cruz died from his injuries the next night
Montgomery’s preliminary has been moved a month to Oct. 4.
