LAS VEGAS (KSNV MyNews3) -- Gary Lee Hosey Jr., the man police say is responsible for the deaths of four people at a bus stop crash on Sept. 13, had his bail set at $4 million at a hearing this morning at the Regional Justice Center.

This comes a day after News 3 learned blood test results showed there was alcohol and marijuana in Hosey's system at the time of the crash on Spring Mountain near Decatur.

Clark County District Attorney Steve Wolfson says prosecutors are waiting for the results of a third blood sample. News 3 is told it was taken before two others.

Earlier results of two tests showed Hosey had alcohol in his system, but he was under the legal limit.

According to the documents News 3 obtained, Hosey's blood was taken nearly two hours after the crash.

Wolfson says he believes the third sample will strengthen their case that Hosey was over the legal limit.

Hosey appeared stoic in court as he listened to his lawyers and prosecutors argue bail amounts. Prosecutors asked for bail to be set at $4 million per death. Defense attorneys asked for $3,000 per death but withdrew it.

Hosey's attorneys also asked Judge Conrad Hafen to get off the case, saying this case shouldn't have automatically gone to a judge who only deals with dui cases. That request was denied.

Hosey's attorneys said after the hearing that have major concerns with the way Metro has handled the investigation.
